1. ACCEPTANCE
Thank you for selecting Mark Lohan Kitchens for your kitchen needs. Below, you will find our terms of sale. We kindly request you carefully review and comprehend these terms and conditions before finalising your order. By placing an order, you acknowledge and agree to
abide by these terms of sale
2. QUOTATIONS & VALIDITY
Quotations are valid for 12 weeks from issue.
Quotations exclude plumbing, electrical works, removal of existing kitchens, and any third-party works unless stated.
Due to market volatility, price increases may be applied prior to order confirmation.
3. PAYMENT TERMS
For orders exceeding €5,000, a €1,000 non-refundable booking deposit is payable upon placing the order, followed by a 50% payment prior to site survey, with the remaining balance due no later than 10 working days before delivery. For orders of €5,000 or less, the full balance is payable prior to site survey. All goods remain the property of MLK until paid for in full. Failure to comply with payment terms may result in delays, rescheduling, or suspension of works and may invalidate any applicable warranty.
4. DESIGN & VARIATIONS
Final plans and specifications must be signed off by the customer prior to manufacture and shall constitute the agreed contract scope. Once signed off, the design is deemed final and binding. Any changes requested after sign-off shall be treated as variations and may result in additional costs, revised pricing, extended lead times, and/or additional installation works. All goods are manufactured specifically to order based on the approved design, and accordingly no cancellations, returns, or refunds shall be accepted once production has commenced, except where goods are proven to be defective, without prejudice to the customer’s statutory rights.
5. LEAD TIMES & INSTALLATION
All delivery and installation dates provided by MLK are indicative estimates only and are dependent on design sign-off, payment compliance, material availability, and site readiness. Standard lead times from final sign-off are typically 8-10 weeks, and 12-14 weeks for in-frame kitchens, but these may vary due to seasonal demand or factors outside MLK’s control. MLK shall not be liable for delays arising from customer changes, site conditions, third-party contractors, or supply chain issues.
6. SITE READINESS (CUSTOMER RESPONSIBILITY)
The customer is responsible for ensuring that the site is fully prepared prior to final measurement and installation, including that walls are plastered, floors are complete, heating has been operational for a minimum of four weeks in new builds, plumbing and electrical services are correctly positioned, full ESB power is available, and all appliances are on site (if supplied by customer). All rooms must be ready at the same time for final measurement, and any return visits or delays caused by incomplete or incorrect site conditions may result in additional charges and revised timelines.
7. INSTALLATION CONDITIONS
Installation is carried out in a live construction environment and, while all reasonable care is taken, minor marks, scuffs, or disturbances to surrounding finishes may occur as part of the normal installation process and shall not be considered defects. Finished flooring should be installed prior to kitchen fitting unless otherwise agreed. MLK does not remove existing kitchens, undertake plumbing or electrical works, or carry out structural alterations such as boring extractor holes. Customers are advised to complete final painting and decorative finishes after installation.
8. APPLIANCES
MLK will position appliances only and does not undertake connection or commissioning, which must be carried out by appropriately qualified professionals. Appliances supplied by the customer must match the specifications provided at design stage, and any discrepancies may result in additional charges. Any appliances not on site which require a fitter to go back to site on a separate date will incur a call out charge of 100 euro plus 50 euro per appliance charge. These charges are payable on the day fitting occurs
10. LIGHTING
Where lighting features form part of the design, MLK may provide physical cabinetry provisions only, and all electrical elements including wiring, drivers, transformers, switching, and connections remain the responsibility of the customer and their electrician. MLK accepts no liability for the performance, installation, or accessibility of lighting components or associated electrical works.
11. SNAGS & COMPLETION
The customer must notify MLK of any visible issues within 5 working days of installation to allow for prompt resolution. MLK will endeavour to address valid issues within a reasonable timeframe, although certain items may require extended lead times depending on materials or manufacturing requirements. Following notification that works are complete, if no response is received within 5 working days, the installation shall be deemed complete, without prejudice to the customer’s statutory rights in respect of defects not reasonably apparent at the time of installation.
12. WARRANTY
MLK provides a 10-year kitchen guarantee, comprising full parts and labour cover for the first five years and parts-only cover for years six to ten, with labour costs chargeable thereafter. This guarantee excludes appliances and third-party products, which are covered by their respective manufacturers, and does not apply to damage caused by misuse, moisture, heat, third-party interference, or failure to follow aftercare guidance. Natural movement in materials, including painted finishes, is also excluded. The warranty is conditional upon full payment and timely reporting of issues and does not affect the customer’s statutory rights.
12. GENERAL
All installation works are carried out with reasonable skill, care, and diligence in accordance with generally accepted industry standards for fitted furniture installation, as required under the Consumer Rights Act 2022. Due to the nature of on-site installation, the finished kitchen will be subject to normal construction tolerances, site conditions, and material characteristics, and shall not be assessed to showroom or factory-finish standards. Minor variances in alignment, levelling, gaps, joints, or finishes, as well as natural variations in materials, shall not be considered defects where they do not affect the functionality, structural integrity, or overall appearance of the kitchen. Workmanship shall be assessed under normal lighting conditions from a reasonable viewing distance and on the basis of fitness for purpose and conformity with the agreed design, rather than subjective or aesthetic preference.
MLK reserves the right to suspend works where payment is overdue, site conditions are unsuitable or compromise the quality and/or safety. Furthermore, MLK is not liable for indirect or consequential loss
